NOTICE OF SALE BY FORECLOSURE Matthew J. Ellis, Substitute Trustee, as recorded in Record Book 569, Page 505, on April 19, 2024, in the Register's Office for DeKalb County, Tennessee, gives notice that the obligation of Lisa Denigne Phoenix to Matthew J. Ellis, Substitute Trustee for First Financial Bank, secured by a Deed of Trust of record in Record Book 514, Page 123, Register's Office for DeKalb County, Tennessee, is in default. Pursuant to the authority of said Deed of Trust, the following described realty will be sold at public auction to the highest bidder on the 29th day of May, 2024, at 11:30 a.m., prevailing time at the DeKalb County Courthouse, 1 Public Square, Smithville, Tennessee 37166. The realty involved is located in the Fourteenth (14th) Civil District of DeKalb County, Tennessee, and is designated as: Land in DeKalb County, Tennessee, being Lot No. 66, as shown on the map entitled Peninsulas Edge, Final Plat, of record in Plat Book 1, page 1507, Register's Office for DeKalb County, Tennessee, to which plan reference is hereby made for a more complete and accurate property description. Said realty is commonly known as: Lot 66, Peninsula's Edge, Smithville, TN 37166, located on Water Ridge Drive, Smithville, TN 37166, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control. For source of title: This being the same property conveyed to Lisa Denigne Phoenix, unmarried, by Warranty Deed of PETNLP, LLC, a Florida Limited Liability Company, dated December 17, 2021, of record in the Register's Office for DeKalb County, Tennessee in Record Book 514, Page 121 on December 27, 2021. The terms of the sale shall be cash, and the realty will be sold, in bar of all equities of redemption, homestead, dower, and all other rights of homestead exemption in, and equitable and statutory redemption of the property, and all marital rights of any type, nature and kind, all of which were waived in the referenced Deed of Trust, and all of such rights of Lisa Denigne Phoenix and those claiming through her, subject to any (1) accrued taxes; and (2) all matters that an accurate and current survey would disclose. COUNTY DELINQUENT TAXES - The aforementioned real property is subject to a lien or claimed lien of DeKalb County, Tennessee for delinquent property taxes for the year 2023, which lien or claimed lien is against Lisa Denigne Phoenix. Also a lien or claimed lien for the 2024 county property taxes not yet due and payable.
