NOTICE OF SUBSTITUTE TRUSTEE'S SALE WHEREAS, Gary D. McComis and Caitlin A. Wescott, husband and wife by Deed of Trust (the "Deed of Trust"), dated September 14, 2020 and recorded on September 15, 2020 in Record Book 507, Page 469-482 or as Document Number 177954, in the Register's Office of Warren County, Tennessee, conveyed to Philip Calahan, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to, Peoples Bank and Trust Company, which the aforementioned Deed of Trust was subsequently assigned to Nationstar Mortgage LLC dated January 19, 2023 and recorded on January 19, 2023 in Record Book 600, Page 127-128 or as Document or Instrument Number 201640, Warren County, Tennessee, and; WHEREAS, Kent D. McPhail of McPhail Sanchez, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Record Book 635, Pages 695-697 or as Document or Instrument Number 211202, Warren County, Tennessee WHEREAS, default has been made in the payment of the Note; and WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust. NOW, THEREFORE, notice is hereby given that an agent of Kent D. McPhail, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, on May 17, 2024 at 12pm at the Courthouse door where the foreclosure sales are customarily held, located in McMinnville, Tennessee will be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Warren County, Tennessee, described as follows: A certain tract or parcel of land located in the 16th Civil District of Warren County, Tennessee, and being more fully described as follows, to-wit: Beginning at a steel stake on Sullivan Road, running southwest 275 feet with William Young's line to another steel stake; thence turning northwest and running 225 to yet another steel stake: thence northeast running 281 feet to a steel stake on Sullivan Road; thence southeast 206 feet running with Sullivan Road to the point of beginning stake.
